This past April, the Virginia Supreme Court rules in Tanner v City of Virginia Beach that Virginia Beach’s noise ordinance was unconstitutionally vague. The use of “unreasonably vague” language as the standard for determining noise violations was ruled to be too subjective. This ruling affects all Virginia localities that have noise ordinances that use the same or similarly vague language as in Virginia Beach’s noise ordinance.
